Privacy Notice

1. Introduction

The Investe Portal is a platform developed with the primary objective of establishing the link between investment project promoters and private investors, promoting collaboration between them and the realization of investment opportunities.

The Investe Portal is integrated in the Agriculture Portal, functioning as an autonomous area that presents an independent access, with its own login and password, guaranteeing the security and confidentiality of the information shared between users, and an independent environment, focused exclusively on the interaction between promoters and investors.

Portal Investe aims to:

• promote investment intentions in agriculture, forestry, aquaculture and fisheries, as well as in processing and agri-food;
• inform promoters of funding possibilities from funds, programmes and financial instruments;
• attracting private investors by putting them in contact with promoters;
• Provide information to national and regional authorities, in particular Managing Authorities (MAs), for the possible launch of call for applications and the achievement of synergies and articulation of funding sources.

2. Scope of the Privacy Notice

This Notice is governed by and interpreted in accordance with Portuguese law and in accordance with the General Data Protection Regulation (Regulation2016/679 of theEuropean Parliament and of the Council of 27 April 2016), and has been drawn up to reinforce the commitment of the Investe Portal to ensure security, privacy and transparency in the processing of personal data.

It describes how personal data is collected, used, stored and shared between the actors of the platform, as well as the rights of data subjects in relation to that information.

3. What is personal data

Personal data is information relating to an identified or identifiable natural person (‘data subject’).

An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, or an identification number.

4. Type of personal data collected

The following personal data are processed on the Investe Portal:

• e-mail address;
• name;
• TIN (Tax Identification Number).

5. Personal data subjects

In the Investe Portal there are two (2) groups of personal data subjects:

• Promoter: a registered user in the reserved area of the Investe Portal who registers one or more projects in order to attract private investors and/or to inform the Managing Authority of his/her investment intention;
• Investor: registered user in the reserved area of the Investe Portal who wants to find potential investments in the agricultural, forestry, aquaculture and fisheries area, as well as in processing and agri-food.

6. Data controller

The responsible for the collection and processing of personal data is the Instituto de Financiamento da Agricultura e Pescas, I.P. (IFAP).

8. Lawfulness for processing

The processing of personal data is carried out on the basis of the express, free, specific, informed and unambiguous consent of the data subject pursuant to Article 6(1)(a) of the General Data Protection Regulation (GDPR).

9. Purposes of processing

The personal data of users are collected and processed for the following purposes:

• Enable the registration and authentication of users in the Investe Portal;
• Enable communication between the Investe Portal Backoffice Manager (IFAP) and project promoters and private investors for the validation and management of user registration and authentication on this portal and, where applicable, for the management of consent for the sharing of the respective data between project promoters and private investors;
• Promote interaction between project promoters and private investors with an interest in them.

10. Sharing of personal data

User data may be shared with:

• IFAP, as the back-office  manager of the Investe Portal, for the purposes of managing user registration and authentication, as well as validating the name and description of projects in the event that they contain personal information;
• Promoters or Investors, in order to promote collaboration between them and the realization of possible investment opportunities, only with the express authorization of the parties involved.

No information will be disclosed or shared with third parties without the explicit consent of the data subject.

11. Withdrawal of consent

The data subject may, at any time, withdraw the consent previously given, without this affecting the lawfulness of the processing carried out up to that date. The withdrawal of consent can be done through your reserved area of the Investe Portal.

In the event of deactivation of data sharing by a Promoter or Investor, the actors with whom the data has been shared are informed of the withdrawal of consent, as well as of the inability to continue to use any previously shared data for any purpose.

12. Rights of data subjects

• Right of access:

The data subject shall have the right to obtain from the controller confirmation as to which personal data concerning him or her are being processed and, where that is the case, access to his or her personal data being processed and to other information relating to the processing thereof.

• Right of rectification:

The data subject has the right to obtain, at any time, the rectification of his or her personal data, which are inaccurate, as well as the completion of incomplete personal data, including by means of an additional statement.

• Right to be forgotten:

The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her, in particular where the data subject withdraws consent on which the processing is based and where there is no other legal ground for such processing.

• Right to restriction of processing:

The data subject shall have the right to obtain from the controller restriction of processing where he or she contests the accuracy of the personal data, for a period enabling the controller to verify the accuracy of the personal data.

• Right to portability:

The data subject has the right to receive the data he or she has provided in a structured, commonly used and machine-readable format, or to request the direct transmission of his or her data to another entity, under the conditions laid down in the legislation in force.

13. Data security

Portal Investe implements technical and organizational security measures to protect data against unauthorized access, loss or alteration.

14. Data retention period

The period of time for which personal data are stored and retained varies according to the purpose for which the information is processed. Where there is no specific legal requirement, the data will be stored and retained only for the minimum period necessary for the purposes for which they were collected or further processed.

15. Right to complain to the Supervisory Authority

Data subjects have the right to lodge at any time a complaint with the competent supervisory authority if they consider that the processing of their personal data infringes the provisions of the General Data Protection Regulation (GDPR). 16. Changes to the security and privacy policy

The Privacy Notice of Portal Investe may be changed, considering that the changes come into force from the date of their placement on this site, making express reference to the date of update.
